The products, technology or processes described in this Website or Data Feed may also be protected by intellectual property rights of Bitnomial, Inc. (“Bitnomial”) or third parties. No license is granted with respect to those intellectual property rights. The content on the Website and Data Feed includes, without limitation: volume, bid-ask prices, opening and closing range prices, high-low prices, settlement prices, indexes, open interest and related information, materials, and content on the Website and Data Feed (“Bitnomial Data”). Bitnomial Data is calculated according to the proprietary methods of Bitnomial entities or certain third-parties with which Bitnomial has a relationship with and through the application of methods, creativity and standards of judgement used and developed through the expenditure of considerable work, time and money, and may be modified from time to time based on this same or other criteria, and all rights, title, and interest therein are expressly reserved by each Bitnomial entity and Bitnomial licensor. All access and use of Bitnomial Data is subject to these Bitnomial Data Terms of Use. You acknowledge and agree that the reservation of rights by Bitnomial in these Bitnomial Data Terms of Use is appropriate.

Permitted Uses

You are only permitted to access and use the Bitnomial Data in the form in which it is in presented on the Website and its Data Feed. You understand, acknowledge and agree, that use of the Bitnomial Data is at your sole risk. You may access content only for your personal use for non-commercial purposes. You understand, acknowledge and agree that the Bitnomial Data is provided "as is" and Bitnomial does not warrant the accuracy, completeness, non-infringement, timeliness or any other characteristic of the Bitnomial Data. All Bitnomial Data contained within the Website and Data Feed should be considered as a reference only and should not be used as validation against, nor as a complement to, Bitnomial’s real time feed via its Data Feed.

We may use the PII collected from you to verify your identity and establish and maintain your account, among other reasons. This information also helps us improve our services to you, customize your browsing experience, and inform you about additional products, services, or promotions that may be of interest to you.

Prohibited Uses

You agree not to, and have no rights to, use the Bitnomial Data to create, calculate, issue, settle, maintain, support or develop any financial instruments (including but, without limitation exchange traded products, certificates, warrants, contracts for difference, swaps, binary options, structured products), indexes, products, services (including but without limitation, portfolio management services, pre- and post-trade risk management services, or valuation services) or any other derivative works without the express written consent of Bitnomial.

You agree not to analyze, reverse-engineer or disassemble any Bitnomial Data and not to insert any code or product to manipulate the Website or Data Feed content in any way that affects any user’s experience. Unless Bitnomial gives you prior written permission, use of any Web browsers (other than generally available third-party browsers), engines, software, spiders, robots, avatars, agents, tools or other devices or mechanisms to navigate, search or analyze the Website or Data Feed is strictly prohibited.

Ownership

You agree that (i) Bitnomial Data and all components thereof constitute copyrighted, and/or proprietary information of substantial value to Bitnomial, (ii) that you receive no proprietary rights whatsoever in or to the Bitnomial Data, and (iii) that title and ownership rights in and to the Bitnomial Data and all the rights therein and legal protections with respect thereto remain exclusively with Bitnomial and its licensors. You shall not, and shall not assist any third party to, assert any rights in the Bitnomial Data or any component thereof or challenge Bitnomial's or Bitnomial Licensor’s rights therein.

Bitnomial is not responsible for technical, hardware or software failures of any kind; lost or unavailable network connections; incomplete, garbled or delayed computer transmissions. Under no circumstances will Bitnomial or its suppliers be liable for any damages or injury that results from the use of the materials on this site. Some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, in which case the above limitation may not apply to you.

Your use of the Website and Data Feed may be monitored by Bitnomial, and the resultant information may be used in accordance with Bitnomial’s Privacy Policy.

The Website and its related pages may provide links to other sites that are not maintained by Bitnomial. Bitnomial does not endorse those sites and is not responsible for the content of such other sites and shall not be liable for any damages or injury arising from that content.

Communication Channel

Bitnomial, Inc. (“Bitnomial”) may coordinate a chat room or communication channel (the “Channel”) to allow current or potential traders an optional way to connect and chat away from any exchange. Bitnomial may use a third-party vendor (“Vendor”) system to facilitate use of the Channel. Use of the Channel does not constitute a commercial or brokerage relationship with Bitnomial, its affiliates, or Bitnomial Exchange, LLC (the “Exchange”). The Channel is not offered by the Exchange. Bitnomial maintains the following terms of use for inclusion in the Channel. Any Channel user (“User”) agrees to the following:

• User shall maintain a valid Vendor business account for Channels hosted on the Vendor system.
• User shall not use the Channel to execute or negotiate trades.
• User acknowledges that User communication outside of the Channel on the Vendor system are not accessible to Bitnomial.
• User agrees and understands that Bitnomial may provide Channel records to the Exchange for any purpose on an ongoing basis.
• User agrees that data transmitted on the Channel may be used in Exchange disciplinary investigations.
• User is responsible for all Exchange and regulatory obligations. Use of the Channel does not relieve the User of any Exchange or regulatory obligations.
• Channel access may be revoked by Bitnomial for any reason at any time.
• User is subject to their respective Vendor user agreement and corporate settings when contacting other Users outside of the Channel.
• Bitnomial and the Exchange are not responsible for any User data retention obligations.
• Bitnomial and the Exchange are not responsible for the accuracy of any messages transmitted on the Channel.
• Bitnomial and the Exchange are under no obligation to provide logs of the Channel to any Users.
• Bitnomial and the Exchange reserve the right to share logs of the Channel with any regulatory body as required by law.
• Bitnomial and the Exchange are not responsible for any monetary losses suffered due to use of the Channel.
• Bitnomial and the Exchange are not responsible for any Vendor-related outages or errors.
